1. Eligibility Requirements

  • H-1B: Open to skilled workers in specialty occupations, with a bachelor’s degree being the primary requirement.

  • O-1: Requires exceptional achievements and recognition in the applicant’s field, often demonstrated through awards, publications, or significant professional contributions.


2. Employer Sponsorship

  • Both visas require a U.S. employer or agent to sponsor the application, but the O-1 visa offers more flexibility in working for multiple employers if they all file petitions.

  • O-1: No cap restrictions, allowing year-round applications.
